Umar Alhaji Mustapha, a resident of Damaturu, the capital of Yobe State, has reportedly impregnated his 18-year-old daughter (name withheld). He would later give her N25,000 to abort it, but she refused to.
The incestophile, according to a local press, was arraigned before a magistrate court in Damaturu, where it was ruled that he would spend 25 years behind bars.
His unlucky daughter told the court her father became furious after realizing she was pregnant and refused to abort it.
Furthermore, the testimony of a witness, a police inspector, noted that the convict had several times, had carnal knowledge of the victim (against her will). This, according to him, resulted in the pregnancy. However, the infant was said to have died at birth.
Mohammed Bilyaminu, the presiding magistrate ruled that all the ingredients of sections 390 and 283 of the penal code were proved by the prosecution.
Bilyaminu, pronounced the accused guilty of incest and rape under sections 390 and 283 of the penal code. The accused pleaded guilty to all charges, appealing to the court to temper justice with mercy.

“I have an aged mother and other dependents to take care of, ” he begged the court.
In response, the convict was given 30 days to appeal against the court’s judgment.
Nonetheless, he was sentenced to five years of imprisonment with a mandatory fine of N5,000 for the offence of incest and an additional 20 years for the offence of rape with N10,000 fine.
