Land Dispute: 13 Years After, Bauchi High Court Delivers Judgment on Lingering Suit

Bauchi High Court Number 5 has delivered judgment on lingers suit of a 13-year old of land matter in favour of the plaintiff.

Our correspondent reported that the land matter was a motion on notice dated 14/03/2017 between the plaintiff Mal. Sagir Haruna and Alhaji Umaru Barade the defendant before Bauchi high Court 13 years after judgement was delivered.

Justice Muazu Abubakar on 28 September 2020  ruled  that after hearing and evaluation of the evidence and submission made through their written address by Nasiru Illehah counsel to the defendant and Hassan Saraki counsel to the plaintiff.

“The plaintiff is the lawful and bonafide owner of the said piece of land lying and situated at miri village covered with right of occupancy No BA/326443.

“Therefore, the court restraints the defendant or his agent and any other persons tempering and doing any other thing with respect to the plaintiff piece of land.

He ordered that the defendant Alhaji Barade should pay the plaintiff Mal. Haruna the sum of N200,000 as general damages.

Justice Abubakar said the defendant’s counterclaims failed, therefore dismissing it .

Mal Haruna ,the plaintiff commended the court bringing to an end the 13 years land matter between him and the defendant to rest.

He said the case took 13 years before the judgement after going and coming finally the court has proven, “I am the rightful owner,” he said.
