Bauchi State High Court has affirmed the suspension of Babayo Aliyu Misau as chairman of the All Progressives Congress in the state.
The court issued a restraining order against Misau and prevents him from presenting himself as a member or chairman of the party.
Justice Lamido Umar, granted the order in a suit filed by Alhaji Al-Mustapha Zubairu with suit number: BA/73/2023.
Justice Umar said he had reviewed the motion ex-parte, the affidavit in support, and the applicant’s written address, which requested an order of interim injunction, according to News Bulletin.
He also considered the exhibits in support of the application, along with the affidavit in support deposed to by Abdulhamid Attahir and the written address of the applicant’s counsel, S.G. Idrees.
As a result, Justice Umar granted the order of interim injunction, restraining Misau from representing himself as the state chairman of the party or as a member of the APC.
“That an order of Interim Injunction be and is hereby made restraining the 1st defendant/respondent (Babayo Misau) from further parading himself as a member of the 2nd defendant/respondent (APC) or the chairman of the 2nd defendant/respondent, pending the determination of the motion on notice.
“That an order of interim injunction be and is hereby made restraining the 2nd Defendant/Respondent from dealing with the 1″ Defendant/Respondent as a Member or the Chairman of the 2nd Defendant/Respondent, pending the determination of the Motion on Notice,” the court ordered.
WikkiTimes had earlier reported the party suspended its chairman over anti-party activities.
His suspension was announced at a press conference jointly held by the executives of his ward, Kukadu Gundari under Misau local council, Bauchi State. The conference was led by the ward chairman, Ibrahim Zango Lawan, who alleged that Alhaji Misau has voted for another governorship candidate during the general elections.
They insisted that the ousted chairman was indefinitely suspended as a result of his violation of the party’s constitution and abuse of his office as a chairman in the state chapter.
