The Benue State Election Petition Tribunal on Saturday upheld the elections of the state governor Rev. Hycienth Alia, the candidate of the All Progressives Congress (APC) in the 2023 governorship election in the state.
Dismissing the petitions filed by the People Democratic Party’s candidate Titus Uba the chairman of the three-man panel Justice Ibrahim Karaye explained that the tribunal has no jurisdiction to entertain them as all matters brought before it were pre-election matters which are captured in section 285 of the Electoral Act.
The tribunal also noted that the petitioner should have approached a higher court than the high court in the cases of non-qualification and the nomination of Governor Alia by the APC and the allegation of a forged certificate and false information against his deputy, Sam Ode before the Independent National Electoral Commission (INEC).
Governor Alia had won the Match election with 473,933 against 223,913 polled by his rival Titus Uba of the PDP.
